In Australia, with no will, the estate goes to the Public Trustee, but there is a provision for a family member to take control of the estate .... it will very much depend on who the deceased made the beneficiary of the Super and life insurance ..... If she is the beneficiary, she will have the best chance of gaining control over the estate, if not .... well, it will be put to who ever the beneficiary is to see if they want to administer it.
If the Public trustee does it, they immediately take 25%, then add costs to distribute the remaining money between surviving relatives, that includes common law partners, but she will have to put her hand up to be recognised as such ..... Having had to do my mother's estate, I'm in no rush to get involved in that stuff a second time .... family greed is far thicker than blood and water etc ......

Terry each state has there own set of 'rules'.
When I took on the job for my sister's death there was no will at all.
There was over 200,000 in bank accounts, nursing home deposit (refund 75%) super plus personal items.
Because no land property was involved public trustees were not invited in but they still took some money to 'approve' .....
In SA closest relatives auto have distribution.
That info is in brief.

I believe in NSW common law wife, has a claim after having lived with the deceased person for a set amount of years 🤔

Thanks guys for your input on friends death etc. I haven't asked her if they even told people their living arrangements.I just assumed they were a "couple" you know friends with benefits. Guess I should ask as C/link would be involved somewhere. I am going to make an appointment with lawyers next week as we just haven't got around to doing wills yet. We actually had some rain today, not much but a start. Nothing exciting happened today either. Hope everyone is keeping fit :lol: Goodnight everyone x :D Goodnight 2ft 6'' aka Peter x :D

3 yrs in South Australia, unless the defacto relationship was registered .... so Google says, I've never heard of such a register .....

I think it's only 3 months in Qld... but could be wrong, I'll ask my son's X wife... She works with solicitors..
