This what I asked about the simple act of firing a gun within the built up town limits…. And the latest response this morning ??????????????????//

Hi there, I was wanting to know if a person has a licence for a firearm and they live in a built up area (within town limits) is that person allowed to discharge their firearm to shoot on their property?

Thank you for you enquiry which has been forwarded to me for a response.
The answer is not clear cut.
Firstly It depends on the purpose of use of the firearms licence.
If it was for hunting / target shooting and club use for example then target shooting on their own property would be permitted under the firearms laws.
However at the same time a person can not
without lawful excuse, discharges a firearm intending to damage any
property
or
without lawful excuse, discharges a firearm and who is reckless as to
whether that act injures, annoys or frightens, or may injure, annoy or frighten
so if the shooting annoys or frightens another person and the act was reckless as to the frightening or annoying it could be a crime if
the person shooting did not have a lawful excuse for the shooting of the gun.

I wanted to know if it was ok for a person that for the sake of argument has a gun licence, is that person allowed to shoot birds i.e. corellas even though he is doing the shooting within town limits i.e. a built up area? I thought there might have been a limit for example no discharging of a firearm within 2 ks of the town limits

No but there may be a council bylaw.
If it is an ongoing problem you could raise it with the local council and have a council by law passed restricting the hours or preventing shooting within the town limits.

That was an unexpected reply. Usually the shooting of birds in a built up area would be considered wreckless behaviour as there is no control over where any stray shots may travel to beyond the line of aim at the bird.
